The European Union has opened a public consultation—which will last until 21 June 2022—on access to data generated by connected vehicles.

The majority of new cars are now connected to wireless networks and therefore generate data flows. This data is currently the exclusive domaine of the manufacturers, who choose which service providers to share it with.

Insurers, repairers, and mobility service providers are lobbying for this data to be opened up so that every driver can have access to it and share it with third parties if they so wish.

The European Union therefore wants to define a legal framework for such access, while avoiding any risk to « cybersecurity, road safety, intellectual property, or data protection. »

In February 2022, the European Commission presented a draft « Data Act« , which aims to give users full control over their data—and more particularly their vehicle data. However, Brussels is questioning the need to supplement this regulation with specific provisions for mobility.

The European Commission therefore opened a public consultation on « access to vehicle data, functions and resources » , with a feedback period from 29 March to 21 June 2022.

This consultation aims to assess the need for new « clear and competition-friendly EU rules for services that are based on access to car data. » The Commission mentions several of these services: « repair and maintenance, car sharing, mobility as a service, and insurance. »
